Terms of Enquiry & Sale

These Terms govern all enquiries and subsequent sales of original artwork (“Artwork”) from Hariclea, operating as My Hart Gallery (“the Artist”, “I”, “me”, “my”) via the enquiry forms on my website at https://myhartgallery.com/ (the “Site”). By submitting an enquiry or proceeding with a purchase, you (“the Client”, “you”, “your”) agree to be bound by these Terms.
1. Artwork & Pricing
All Artwork featured on the Site is an original, physical creation by the Artist, Hariclea. Prices are not displayed online. All price quotations provided by the Artist in response to your enquiry are valid for 14 days and are subject to the Artwork’s availability. The Artist reserves the right to amend prices at her discretion.
2. The Enquiry & Sale Process
a. Enquiry: Submitting an enquiry via the Site or email does not constitute a binding agreement to purchase. It is an invitation for you to discuss a potential sale.
b. Quotation & Agreement: Following your enquiry, I will provide a price quotation and available payment methods via email. A sale is only finalised once:
i. You confirm your acceptance of the quotation in writing (email suffices).
ii. You have paid a non-refundable deposit (typically 50%) or the full amount as specified in the quotation.
iii. I send a written confirmation of sale, which will form the agreement between us.
c. Commissioned Work: Terms for bespoke commissions will be detailed in a separate Commission Agreement prior to any work beginning, requiring a non-refundable deposit.
3. Payment
Accepted payment methods will be specified in your quotation (typically via bank transfer). Full payment must be received in cleared funds before the Artwork is dispatched or made available for collection. Title (legal ownership) of the Artwork remains with the Artist until full payment is received.
4. Shipping, Delivery & Risk
The Client is responsible for all shipping, insurance, and delivery costs. Costs will be agreed upon and added to your final invoice prior to dispatch. Once the Artwork is handed to a professional courier, risk of loss or damage passes to the Client. It is the Client’s responsibility to ensure adequate insurance is in place. For collection in London, details will be arranged upon sale completion.
5. Returns & Refunds
Due to the unique nature of original artwork, all sales are final. I do not accept returns or offer refunds for change of mind. This does not affect your statutory rights.

6. Copyright & Intellectual Property
Hariclea (My Hart Gallery) retains all copyright and intellectual property rights in the Artwork indefinitely. Purchasing the physical Artwork does not grant the Client any right to reproduce, distribute, or create commercial derivatives from the image of the Artwork. The Artist asserts her moral right to be identified as the author of the work. Clients are encouraged to share images of the Artwork in their personal spaces with credit to @myhartgallery.
7. Data Protection
Your personal data will be handled in strict accordance with my Privacy Policy below, used solely to process your enquiry and manage our communication.
8. Governing Law
These Terms, and any dispute arising from them, shall be governed by and construed in accordance with the laws of England and Wales.
